1. Who we are

“We”, “us” and “our” refer to the developer of SWISH. “You” refers to the person using the game.

2. Acceptance

By downloading, installing or playing SWISH you agree to these terms. If you do not agree, do not install or use the game. If you use SWISH on behalf of someone else, you confirm you are allowed to accept these terms for them.

3. Licence to use the game

We grant you a personal, non-exclusive, non-transferable, revocable licence to install and play SWISH for your own private, non-commercial entertainment. This licence does not transfer ownership of the game or its content to you. All rights not expressly granted are reserved.

4. Google Play

SWISH is distributed through Google Play. Your download and use are also subject to the Google Play Terms of Service. Refunds and payment matters are handled by Google under those terms. Nothing in these terms limits rights you have against Google or that Google has against you.

5. Acceptable use

You agree not to:

  • use SWISH for any unlawful purpose or in breach of applicable law;
  • reverse engineer, decompile or modify the game except where permitted by law;
  • redistribute, rent, lease or sell the game or any part of it;
  • remove or alter any copyright, trademark or attribution notices;
  • use the game or its assets to train or build a competing product without our written permission.

6. No warranties

SWISH is provided “as is” and “as available”. To the extent permitted by law we make no warranty that the game will be uninterrupted, error free or fit for a particular purpose. Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, for fraud, or for any liability that cannot be limited by law.

7. Limitation of liability

To the extent permitted by law, we are not liable for indirect or consequential loss, loss of data, loss of profit, or loss of goodwill arising out of the use of or inability to use SWISH. Where liability cannot be excluded, it is limited to the amount you paid for the game, which may be zero.

8. Updates and changes

We may release updates, change features, or discontinue the game. We may also update these terms; the current version is always published on this page with its effective date. Continuing to use the game after a change means you accept the updated terms.

9. Intellectual property

The game, its code, artwork, sounds, name and logo are owned by us or licensed to us and are protected by copyright and other laws. The Godot engine is used under its own licence (MIT).

10. Governing law

These terms are governed by the laws of Austria, without regard to conflict-of-law rules. Mandatory consumer protection rules of your country of residence remain unaffected. The competent courts are those of Linz, Austria, unless the law requires otherwise.
